This Policy applies as between you, the User of this Web Site and CodePLC LLC the owner and provider of this Web Site. This Policy applies to our use of any and all Data collected by us in relation to your use of the Web Site and any Services or Systems therein.
In this Policy the following terms shall have the following meanings:
"Account": means collectively the personal information, Payment Information and credentials used by Users to access Material and / or any communications System on the Web Site;
"Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;
"Cookie": means a small text file placed on your computer by CodePLC LLC when you visit certain parts of this Web Site. This allows us to identify recurring visitors and to analyze their browsing habits within the Web Site.

"Website": means the website that you are currently using, codeplc.com, and any sub-domains of this site unless expressly excluded by their own terms and conditions.

Payments are processed by Stripe, Inc. We do not receive, process or store your full credit or debit card number. Stripe provides us with a transaction record which may include the last four digits of your card, the card brand, the billing country and the transaction outcome.

2.4 Data we do not collect. We do not collect your date of birth, your telephone number, your postal address, your government identification numbers, or any special category data as defined under the GDPR.

- 5.2 Any Data processed by these parties must be processed in accordance with this Policy and with applicable data protection law.

- 5.3 We do not sell your personal Data, and we do not share it with advertisers or data brokers.
- 6.1 CodePLC LLC may, from time to time, expand or reduce its business and this may involve the sale of certain divisions or the transfer of control of certain divisions to other parties. Data provided by Users will, where it is relevant to any division so transferred, be transferred along with that division and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was supplied by you.
- 6.2 In the event that any Data submitted by Users will be transferred in such a manner, you will be contacted in advance and informed of the changes. When contacted you will be given the choice to have your Data deleted or withheld from the new owner or controller.
- 7.1 Wherever you are required to submit Data, you will be given options to restrict our use of that Data. This may include the following:

- 7.1.2 sharing Data with third parties.
- 8.1 You may access certain areas of the Web Site without providing any Data at all. However, to use all Services and Systems available on the Web Site you may be required to submit Account information or other Data.

- 9.1 We retain Account and purchase records for the duration of your Account and for a further seven (7) years thereafter, in order to meet tax, accounting and legal obligations.
- 9.2 Email marketing Data is retained until you unsubscribe. Following unsubscription we retain a minimal suppression record indefinitely, for the sole purpose of ensuring we continue to honor your unsubscribe request.
- 9.3 Website analytics Data is retained in accordance with the retention settings of our analytics provider.
- 9.4 Communications you send us are retained for up to three (3) years, or longer where necessary to establish, exercise or defend legal claims.
- 10.1 We use cookies and similar technologies on the Web Site. These fall into the following categories:

- 11.2 Where Data is transferred from the European Economic Area or the United Kingdom, we rely on appropriate safeguards, including Standard Contractual Clauses implemented by our service providers, and on any applicable adequacy decisions or data privacy framework certifications held by those providers.

- 12.2.4 opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under the CCPA, and we have not done so in the preceding twelve months;

Email support@codeplc.com stating the right you wish to exercise and the email address associated with your Account. We may need to take reasonable steps to verify your identity before acting on a request.
We will respond within 30 days. For CCPA requests, we will respond within 45 days, and will notify you if an extension is required.
Exercising your rights is free of charge. We may charge a reasonable fee, or refuse to act, only where a request is manifestly unfounded or excessive, in particular because of its repetitive character.
If you are in the EEA or UK and believe we have not handled your Data lawfully, you have the right to lodge a complaint with your national data protection supervisory authority. In the United Kingdom this is the Information Commissioner's Office (ico.org.uk). We would be grateful for the opportunity to address your concern directly before you do so.

- 13.1 The Services are not directed to children. We do not knowingly collect personal Data from any person under the age of 16.
- 13.2 If you believe that a child under 16 has provided us with personal Data, please contact support@codeplc.com and we will delete it.
- 14.1 Data security is of great importance to CodePLC LLC and to protect your Data we have put in place suitable physical, electronic and managerial procedures to safeguard and secure Data collected online. These include encryption of Data in transit using TLS, access controls limiting who may access Data, and the use of reputable service providers who maintain their own recognized security standards.
- 14.2 No method of transmission over the internet or method of electronic storage is completely secure. While we take reasonable steps to protect your Data, we cannot guarantee absolute security.
- 14.3 In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority and, where required, affected individuals, in accordance with applicable law.
CodePLC LLC reserves the right to change this Privacy Policy as we may deem necessary from time to time or as may be required by law. Any changes will be posted on the Web Site with an updated effective date. Where changes are material, we will notify registered Users by email at least 14 days before the changes take effect.
